Surrogacy in Washington

Is Surrogacy Legal in Washington?

Yes. Washington is one of the most surrogacy-friendly states in the country thanks to the Washington Uniform Parentage Act (RCW 26.26A), which took effect on January 1, 2019. Here’s what intended parents and surrogates should know about Washington surrogacy law:

Gestational surrogacy is fully legal and enforceable. Washington law specifically recognizes and enforces gestational carrier agreements when statutory requirements are met. The law provides clear protections for intended parents, surrogates, and the child throughout the process.

Pre-birth parentage orders are available. Washington courts routinely issue pre-birth parentage orders in gestational surrogacy cases, allowing intended parents to establish their legal parentage before delivery. The order becomes effective upon the child’s birth.

All families are protected. Washington law allows married couples, unmarried couples, LGBTQ+ families, single parents by choice, and intended parents using donor eggs, donor sperm, or donor embryos to establish legal parentage through surrogacy.

Washington has clear legal safeguards. To have an enforceable gestational carrier agreement, Washington law requires, among other things, that:
• The surrogate has previously given birth to at least one child.
• The surrogate and intended parents are at least 21 years old.
• All parties complete medical and psychological screening.
• Each party has independent legal representation.
• A comprehensive gestational carrier agreement is completed before any medical procedures begin.

Experienced legal guidance is essential. Every Washington surrogacy journey should include an experienced assisted reproduction attorney for both the surrogate and intended parents. Accel Conceptions partners with knowledgeable Washington reproductive attorneys to ensure every journey is handled safely, legally, and with confidence.

  • “This is the best agency! Everybody on the team is so hands-on, and so helpful. They always help you with questions and never make you feel less then! Thank you so much”

    Ashlynn B.

  • “I would give more stars if I could! Monica has been absolutely amazing. I am only in the beginning stages of my surrogacy journey, but my experience thus far has been so seamless. I had a not-so-great experience with an agency I was using before I was referred here, it was a breath of fresh air when I first spoke with Monica. They are always communicating and updating me with what is going on, never once have I been stuck wondering. If you are looking to become a surrogate mama, I absolutely recommend you stop looking and come here.”

    Taylor M.

  • “Finding Accel Conceptions has been such a blessing in my life. I have embarked on a beautiful, rewarding journey of giving another family a baby of their own through me being their gestational surrogate. Since the beginning, Accel has been so helpful, knowledgeable, and supportive. They have answered all my questions, calmed all my fears, and just have been here with me every step of the way. I always know that the phone will be answered or the email will be replied to within minutes. If you were like me and searching for the right agency to go with, look no further. This agency is more of a sisterhood and family than anything else. You are in amazing hands with these ladies.”

    Kalen S.

  • “Accel has been nothing short of absolutely amazing for a surrogacy journey. From a surrogate standpoint, I have nothing but great things to say. Not only about Monica, but the entire agency as a whole. The way everything is handled, you can tell that the experience in the industry is there. I know I will definitely be perusing additional journey's as long as all goes to plan.”

    Sierra H.

  • “I am a first-time surrogate, and the main reason I picked Accel Conceptions was because they are local to me, and the support they provide is nothing short of amazing. I loved finding out that they held retreats for ALL the ladies in the agency, near and far. The online support groups are great, but the retreats give us all a way to bond with each other in person, and not just online. They also hold group dinners once-a-month for us where we can check in, play games, eat, win raffle prizes, bond, meet new surrogates joining us, and ask any questions we may have going through the process. I have made lifelong friends being a part of Accel, and it all started with taking the leap to do something amazing for a family that is unable to have a child of their own. It's a true win-win situation! From day one of contacting the agency with questions to now, 37 weeks pregnant, I am so glad I am on this journey, and I have been so grateful to have Monica and the whole Accel team there every step of the way.”
