Yes. Idaho is one of the newest states to adopt comprehensive surrogacy legislation. The Idaho Gestational Agreements Act (House Bill 264), which became effective July 1, 2023, formally recognizes gestational surrogacy and provides a clear legal framework for intended parents and gestational carriers.
Gestational surrogacy is protected by state law. Under Idaho law, intended parents who enter into a valid gestational carrier agreement are recognized as the child’s legal parents, providing legal certainty and security throughout the surrogacy journey.
Pre-birth parentage orders are available. Idaho courts grant pre-birth parentage orders, allowing intended parents to establish their legal parentage before delivery. These orders are available for a wide variety of family structures, including those using donor eggs, donor sperm, or donor embryos.
All families can pursue surrogacy. Idaho law supports married and unmarried couples, LGBTQ+ families, and single intended parents. Parentage orders are available regardless of whether the intended parents have a genetic connection to the child.
Certain jurisdiction requirements apply. To utilize Idaho’s Gestational Agreements Act, either one party to the surrogacy agreement must have lived in Idaho for at least six months before signing the agreement, or the arrangement must otherwise have sufficient legal connections to the state.
