Pre-birth parentage orders are available. Washington courts routinely issue pre-birth parentage orders in gestational surrogacy cases, allowing intended parents to establish their legal parentage before delivery. The order becomes effective upon the child’s birth.

All families are protected. Washington law allows married couples, unmarried couples, LGBTQ+ families, single parents by choice, and intended parents using donor eggs, donor sperm, or donor embryos to establish legal parentage through surrogacy.

Washington has clear legal safeguards. To have an enforceable gestational carrier agreement, Washington law requires, among other things, that:
• The surrogate has previously given birth to at least one child.
• The surrogate and intended parents are at least 21 years old.
• All parties complete medical and psychological screening.
• Each party has independent legal representation.
• A comprehensive gestational carrier agreement is completed before any medical procedures begin.
